LARA’s New Esthetician Laws – Effect on Medical Spas

MISpa (Michigan Medical Spa Association) is committed to working with lawmakers to ensure that the medspa industry is represented fairly and accurately in regard LARA laws implemented in the state of Michigan. Currently, MISpa is working closely with LARA on the state’s new proposed esthetician laws referred to as pending rule set 2022-19 LR. 

Currently in the promulgation process, these proposed rules would have an impact on the aesthetics industry.

How do the Pending Rules Affect Medical Spas?

Several of the proposed changes are about performing many common medical spa procedures. These include laser treatments, dermal fillers & injections, microneedling, and microdermabrasion. Licensing And Regulatory Affairs announced that under the changes, such services should be performed only by a healthcare professional. Under the proposed rules, estheticians would be prohibited from:

  • Using a blade cut, shaving, or removing any layer of the skin or skin growths from anywhere on the body
  • Performing medical treatments including, but not limited to, microdermabrasion, dermaplaning, hydrodermabrasion and Botox injections
  • Using or possessing any device, apparatus, appliance, product, technique or practice to abrade, remove, resurface, pierce, puncture, or inject any tissue or skin layer below the stratum corneum
  • Diagnosing or treating any human disease, ailment, defect, complaint, or other physical or medical condition
  • Using or possessing a laser or an ultrasound for any purpose

How Can Medical Spas Continue Performing These Treatments?

Good news for medical spas – estheticians would be able to perform these services under the delegation of a medical director. While the proposed rules state that estheticians would be unable to perform cosmetic medical procedures, they would be allowed if they are acting as unlicensed medical assistants under a physician.
